Call to Order
Judge-Executive Ralph Drees called to order the November 14 meeting of the Kenton County Fiscal Court at the Independence Courthouse with Commissioners Koenig and Humpert present. Others in attendance included County Attorney Edmondson, Deputy Judge/Executive Kimmich, County Treasurer Frye, Police Chief Butler, and Human Resources Director Shriver.
Invocation and Pledge of Allegiance
The invocation was offered and pledge was led by Commissioner Dan Humpert.
Approval of Minutes
Judge Drees presented the minutes of the meeting held on October 24, 2006, for approval of the court. Commissioner Humpert moved approval of the minutes as presented and Commissioner Koenig seconded the motion. There being no further discussion on the motion, Judge Ralph Drees called for voice vote on the motion and all members present voted in the affirmative.
Delegations
Judge Ralph Drees recognized Dr. Ed Mauntel, Executive Director of NorthKey Community Care, for a report from the regional mental health agency. Dr. Mauntel reported that the agency is currently celebrating its fortieth anniversary as a mental health services provider and presented to the court a statistics concerning the operation of the agency. Dr. Mauntel also advised that NorthKey is in the process of expanding programs into schools in three counties.
Judge Drees asked for a county breakdown of the funds expended and clients served in Kenton County by the agency.
Commissioner Humpert questioned Dr. Walsh concerning the statistics as to the success of the program in the Kenton County Detention Center as it relates to recidivism and was advised that at the present there are no statistics as the program is in the beginning stages.
County Jailer Terry Carl expressed his strong support for the program and said that the follow-up is critical to the overall mission of the jail to break the cycle of recidivism.
General Business
Judge Ralph Drees sought authorization to proceed in executing necessary documents upon review by the County Attorney on behalf of the county and subsidiaries thereof enabling Kenton County residents to participate in the National Association of County Officials (NACo) Prescription Drug Card program as established by and between a partnership including NACo and the Kentucky Association of County Officials (KACo) and called on Deputy Judge Kimmich to report.
Mr. Kimmich advised that this is a national cooperative program by and between NACo and KACo and that the participation of the county in such a program at no cost to the county would be beneficial to the county. This program provides reductions of up to 20 percent in drug costs for some patients and is currently in place in 14 states.
Commissioner Humpert said he had read about the program in the NACo newsletter and that he felt this would be a good program for the county.
Commissioner Humpert moved approval of the request for authorization to execute the contract upon review by the county attorney and Commissioner Koenig seconded the motion. There being no further discussion on the motion, Judge Ralph Drees called for voice vote on the motion and all members present voted in the affirmative.
Judge Ralph Drees requested authorization to issue requests for qualifications consistent with the Kenton County Procurement Policies for engineering services for highway and road construction work for calendar years 2007-2008.
Commissioner Koenig moved approval of the request for authorization to proceed in securing requests of qualifications of engineering services for 2007-2008 and Commissioner Humpert seconded the motion. There being no further discussion on the motion, Judge Ralph Drees called for voice vote on the motion and all members present voted in the affirmative.
Judge Drees requested authorization to issue requests for qualifications for architectural design and site engineering for the construction of a Kenton County Detention Center.
Commissioner Humpert moved approval of the request for authorization to proceed in securing requests of qualifications of architectural and site engineering services for the construction of a county detention center and Commissioner Koenig seconded the motion. There being no further discussion on the motion, Judge Ralph Drees called for voice vote on the motion and all members present voted in the affirmative.
Resolutions
There were no resolutions to come before the court for approval.
Ordinances
Judge Drees presented Ordinance No. 924.32 for second reading amending the zoning map for an approximate 94 acre parcel located at the Southeast corner of the intersection of Taylor Mill Road with Manor Lake Drive from R-1B (single family) and A-1 (agricultural) to R-1B, single family residential zone with a planned united development overlay zone as recommended for approval by the Kenton County and Municipal Planning & Zoning Commission.
Commissioner Humpert moved approval of the second reading of Ordinance 924.34 adopting the findings of facts of Kenton County and the Municipal Planning & Zoning Commission and Commissioner Koenig seconded the motion. There being no further discussion on the motion, Judge Ralph Drees called for roll call vote on the motion whereupon Judge Drees and Commissioners Koenig and Humpert all voted aye.
Judge Drees presented for first reading Ordinance No. 924.33 to amend the zoning map for an approximate 158.5 acre area formerly incorporated as the city of Visalia made up of an approximate 3.5 acre area located at the Southeast corner of the intersection of Decoursey Pike with KY 536 bridge (area A) and an approximate 155 acre area located along the East and West sides of Decoursey Pike, generally between Visalia Road and the KY 536 bridge (area B) establishing RC (rural commercial) zone for area A and A-1 (agricultural one) zone for area B.
There being no discussion, the ordinance was posted for second reading on November 21, 2006.
Judge Drees presented first reading of Ordinance No. 225.45 providing for the implementation and collection of an insurance premium tax in unincorporated Kenton County at a rate of eight percent of the premium paid on insurance other than life and health.
There being no discussion, the ordinance was posted for second reading on December 12, 2006.
Judge Drees presented first reading of Ordinance No. 924.34 adopting the findings of the Kenton County Planning Commission providing for a text amendment to the Kenton County Zoning Ordinance providing for the creation and definition of a classification and designation of an eco-commerce zone in unincorporated Kenton County.
There being no discussion the ordinance was posted for second reading on December 12, 2006.
Judge Drees presented first reading of Ordinance No. 924.35 adopting the findings of the Kenton County Planning Commission providing for the adoption of a zoning map amendment providing for the creation of an eco-commerce zone and rezoning approximately 900 acres in unincorporated Kenton County as set forth in the maps attached to the recommendation of the Kenton County Planning Commission which shall be incorporated in the official record of the Kenton County Fiscal Court.
Commissioner Humpert moved that upon second reading he would like the court to consider adopting the entire area as recommended by the commission staff, overriding the recommendation of the Kenton County and Municipal Planning & Zoning Commission and Commissioner Koenig seconded the motion. There being no further discussion, Judge Drees called for a voice vote whereupon all members present voted aye.
There being no further discussion, the ordinance was posted for second reading as noted on December 12, 2006.
Claims List
Judge Drees presented the claims list and hearing no objections directed that warrants will be issued and claims will be paid.
Executive Orders
Judge Drees presented Executive Order No. 06-88 accepting the resignation of Steven Megerle from the Kenton County Unified Code Enforcement Board and appointing Claire Moriconi to serve in said capacity, effective January 1, 2007.

Commissioner Humpert moved ratification of the executive order as presented and Commissioner Koenig seconded the motion. There being no further discussion on the motion, Judge Ralph Drees called for a voice vote and all members present voted in the affirmative.
Judge Ralph Drees presented Executive Order No. 06-84 accepting the resignation of Scott A. Justice as a park trustee for the Department of Parks and Recreation, effective October 31, 2006.
Commissioner Humpert moved ratification of the executive order as presented and Commissioner Koenig seconded the motion. There being no further discussion on the motion, Judge Ralph Drees called for voice vote on the motion and all members present voted in the affirmative.
Judge Drees presented Executive Order No. 06-85 terminating the employment of Bill Boles as advanced equipment operator for the golf courses, effective October 30, 2006.
Commissioner Koenig moved ratification of the Executive Order as presented and Commissioner Humpert seconded the motion. There being no further discussion on the motion Judge Ralph Drees called for voice vote on the motion and all members present voted in the affirmative.
Judge Drees presented Executive Order No. 06-86 appointing Shana Holtkamp to the position of purchasing clerk in the office of the Kenton County Treasurer, effective November 6, 2006.
Commissioner Koenig moved ratification of the executive order as presented and Commissioner Humpert seconded the motion. There being no further discussion on the motion, Judge Ralph Drees called for a voice vote, and all members present voted in the affirmative.
Judge Drees presented Executive Order No. 06-97 accepting the resignation of Mark Helmer as part-time maintenance technician for the Kenton County Golf Courses, effective October 12, 2006.
Commissioner Humpert moved ratification of the executive order as presented and Commissioner Koenig seconded the motion. There being no further discussion on the motion, Judge Ralph Drees called for a voice vote and all members present voted in the affirmative.
Citizens Address
No citizens appeared before the court seeking recognition.
Administrative Reporting
Deputy Judge-Executive Scott Kimmich advised he had nothing else to bring before the court.
Treasurer Ivan Frye said that unless there are objections, he would like to proceed in the issuance of a request for qualifications for financial advisors/fiscal agents in anticipation of activities in the coming year. There being no objections, Judge Drees advised Mr. Frye to continue.
Human Resources Director Joe Shriver advised he had nothing to bring before the court.
County Attorney's Report
County Attorney Garry L. Edmondson advised that there have been rumors to challenges in the vote to dissolve the city of Latonia Lakes and to date there has been no such action filed. He has already begun the task of determining the process by which the county would take responsibility for the assets of the city within 30 days of the vote of the citizens to disband the city.
Commissioners' Reports
Commissioner Dan Humpert advised that Commissioner-Elect Kris Knochelmann is present for the meeting tonight and he wanted to take this opportunity to congratulate Commissioner Knochelmann.
He also wanted to congratulate Commissioner Adam Koenig on his election to the Kentucky House of Representatives.
Commissioner Adam Koenig advised he had nothing to bring before the court.
Judge-Executive's Report
Judge-Executive Ralph Drees said he would also like to congratulate Commissioner-Elect Knochelmann and Commissioner Koenig on their victories.
Executive Session
There was no need for an executive session.
Adjournment
There being no further business to come before the court, Judge Drees requested a motion to adjourn which was offered by Commissioner Koenig and seconded by Commissioner Humpert. There being no discussion, Judge Drees called for a vote on the motion whereupon all members voted aye.
