The regular meeting of the Kenton County Fiscal Court was called to order at the Independence Courthouse. Present at the meeting were Judge Executive Ralph A. Drees; Commissioners Dan Humpert, Barbara Black and Adam Koenig; County Attorney Garry Edmondson; County Treasurer Ivan Frye; Human Resources Director Joe Shriver; Public Works Director Joe Murphy; Assistant County Attorney Stacey Hege; Assistant County Attorney Brandon Voelker; Special Projects Manager Ralph Bailey; Jailer Terry Carl; Police Chief Bill Dorsey; Court Reporter Cathy Johnston; and Guests.
Deputy Judge Executive Scott Kimmich was absent because of illness.
Invocation and Pledge of Allegiance
The invocation was given and pledge of allegiance led by Commissioner Adam Koenig.
Approval of Minutes
Judge Dress asked for approval of the minutes for the last meeting. Commissioner Black moved for approval with a second from Commissioner Humpert with corrections previously given to the clerk. The minutes were unanimously approved with the vote of aye.
Delegations
There were not any delegations to come before the court.
General Business
There was not any general business presented to the court.
Resolutions
No resolutions were brought before the court.
Ordinances
ORDINANCE NO. 950.85-First reading for the establishment of the Kenton County Code Enforcement Board, Garry Edmondson reporting: In order to enforce the one-stop shop, there has to be an enforcement board in place and this ordinance creates that board. The cities that are a part of the service the area planning commission is providing will also use this enforcement board and nominations will be sought from these cities. Commissioner Koenig made a motion for the ordinance followed with a second by Commissioner Black. The motion was unanimously approved upon roll call.
ORDINANCE NO. 225.40-First reading for adoption of the Kenton County Fiscal Court budget for fiscal year 2006, Ivan Frye reporting: The county is moving for approval of the budget and after a review by the state local finance officer, there will be a second reading. Mr. Frye said the budget had been previously reviewed with minor adjustments that made no significant changes. Commissioner Humpert said the document had been reviewed at the fiscal court retreat and made the motion to approve the budget on the first reading. A second was given by Commissioner Black and the motion unanimously passed with a roll call vote.
Consent Agenda
CLAIMS LIST-County Treasurer Ivan Frye: No questions were asked and the claims list was approved.
Administrative Actions
HANDOUT NO. 05-22-Authorization for Judge Executive to execute documents between the Kenton County Fiscal Court and Emerson Power Transmission Corporation, Ivan Frye reporting: A termination of a deed that was held in the name of the county for industrial revenue bonds issued approximately 30 years ago. They have been paid off but the company never prepared the deed to bring back to the county. Commissioner Humpert asked if the county attorney should approve the documents and Mr. Edmondson answered yes.
Commissioner Humpert made the move for the motion to pass contingent upon approval by the county attorney; seconded by Commissioner Koenig. The motion unanimously passed on roll call.
HANDOUT NO. 05-23-Request permission to extend the contract for Ford vehicle replacement parts between Kenton County Fiscal Court and Airport Ford from June 1, 2005 through May 31, 2006, Ivan Frye reporting: This is the contract that was originally awarded with the option to extend for one year terms. They have agreed to extend it at the same terms which is a 15 percent discount off of their price. Commissioner Black moved for approval with a second from Commissioner Koenig and the motion was unanimously approved on roll call.
HANDOUT NO. 05-24-Recommendation for the Kenton County Fiscal Court to award a bid for gasoline to Petroleum Traders and BP Oil for the term of June 1, 2005 through May 31, 2006, Ivan Frye reporting: Commissioner Koenig moved for approval; seconded by Commissioner Humpert. The motion was unanimously approved upon roll call vote.
Executive Orders
EXECUTIVE ORDER NO. 05-32-Appointment of Scott Pracht as animal control officer for the Department of Public Safety, effective May 10, 2005: Commissioner Black made the motion for approval with a second from Commissioner Humpert. The motion unanimously passed with the vote of aye.
EXECUTIVE ORDER NO. 05-33-Appointment of two part-time employees for the golf courses, effective May 10, 2005: Judge Drees asked Mr. Shriver to explain the difference between the two salaries listed for the two employees and asked if these were the correct amounts. Mr. Shriver answered that the person working in the clubhouse is not doing manual labor and the other person is doing heavier work and these are two different classifications. The employee doing the manual labor is the one being paid the higher salary. Commissioner Humpert made the motion for approval with a second from Commissioner Black and the motion carried with the unanimous aye vote.
EXECUTIVE ORDER NO. 05-34-Appointment of two seasonal maintenance employees for the golf courses, effective May 10, 2005: Commissioner Koenig moved for approval; seconded by Commissioner Black and the motion unanimously passed with the aye vote.
EXECUTIVE ORDER NO. 05-35-Appointment of Craig Twehues as seasonal equipment operator for the Department of Public Works, effective May 10, 2005: Commissioner Humpert made the motion for approval; followed by a second from Commissioner Koenig. The motion unanimously passed with a vote of aye.
Citizens Address
There were not any citizens present that wished to address the court.
Administrative Reporting
DEPUTY JUDGE EXECUTIVE-Scott Kimmich: Absent because of illness.
COUNTY TREASURER-Ivan Frye: Asked for a motion of the court to appoint him or someone of the court's choosing to conduct the annual settlement of tax collections from the sheriff's office. It has to be on record that someone is appointed and report to the court at the next meeting. This has to be done annually before the sheriff can receive new tax bills to collect and the state also requires this. The taxes have been collected and everything is in order.
Commissioner Black moved for the appointment of Mr. Frye to do the settlement of the tax collections with a second from Commissioner Humpert. The motion unanimously passed with the aye vote.
HUMAN RESOURCES DIRECTOR-Joe Shriver: Wished Deputy Judge Kimmich a speedy recovery.
COUNTY ATTORNEY'S REPORT-Garry Edmondson: Nothing to report.
Commissioners' Reports
COMMISSIONER BARBARA BLACK-Nothing to report.
COMMISSIONER DAN HUMPERT-Said he also wished Mr. Kimmich a speedy recovery. A lot of times the work of the police department goes unnoticed and we do not hear a lot of the good things they are doing. The first class of the youth citizens' police academy has had their graduation and Chief Dorsey was asked if he would relate the activities to the court.
Chief Dorsey said community-oriented policing is what started the concept of police academies for the public and it was decided to take it one step further to mentor youth. Children throughout Kenton County were picked with the help of the school board and they were put into a mentoring type of program. The things learned are items that will not be learned in school such as quality of life issues that a good citizen practices. There has been interest from other schools as to how this is being done and calls are also coming in from police agencies. A lot of the labor in the program is volunteers that came from graduate police academies on the adult side. The premise is to take good children to make them into good citizens and there is no such thing as a bad child.
COMMISSIONER ADAM KOENIG-Nothing to report.
Judge-Executive's Report-There is a luncheon today honoring Bill Robinson and tomorrow Jim Huff will be honored by Holmes High School. These are both fundraisers for scholarships.

Adjournment
There being no further business to come before the court, Commissioner Humpert made the motion to adjourn; seconded by Commissioner Black. The court was adjourned with the unanimous vote of aye.
