KENTON COUNTY FISCAL COURT

 

M I N U T E S

 

JUNE 26, 2007, 7:00 P.M.

 

The regular meeting of the Kenton County Fiscal Court was called to order at the Independence Courthouse.  Present at the meeting were Judge Executive Ralph A. Drees; Commissioners Kris Knochelmann and Sara Voelker; Assistant County Attorney Stacy Hege; County Treasurer Ivan Frye; Human Resources Director Joe Shriver; Police Chief Ed Butler; Public Works Director Joe Murphy; Jailer Terry Carl; Deputy Sheriff Pat Morgan; Director of Fleet Management Roger Wells; Court Reporter Cathy Johnston; and Guests.

 

Deputy Judge Executive Scott Kimmich and Commissioner Dan Humpert were absent because they were out of town to a meeting.

 

Invocation and Pledge of Allegiance

 

The invocation was given and pledge of allegiance led by Commissioner Knochelmann­­­­­­­­­­­­­

 

Approval of Minutes

 

Judge Drees asked the court for approval of the minutes dated June 12, 2007.  Commissioner Knochelmann made the motion for approval; seconded by Commissioner Voelker.  The motion was unanimously approved with the vote of aye.

 

Delegations

 

There were not any delegations to appear before the court.

 

General Business

 

No general business items were brought to the court's attention.

 

Resolutions

 

Resolution No. 07-01D

Approval of changes in the line items of the budget because of unanticipated expenses between appropriation accounts to provide necessary funding for these items as identified, Ivan Frye reporting:  These adjustments are necessary because of under budgeting for these line items at the beginning of the year.  Commissioner Knochelmann made the motion to accept; seconded by Commissioner Voelker and the motion unanimously passed with a roll call vote of Commissioner Voelker voting yes; Commissioner Knochelmann voting yes and Judge Drees voting yes.

 

Resolution 07-15

Approval of established salaries of Kenton County employees, Ivan Frye reporting:  The court is being asked to authorize the attached salaries for county employees.  Commissioner Knochelmann made the motion for approval followed by a second from Commissioner Voelker.  The motion unanimously passed with a roll call vote of Commissioner Knochelmann, yes; Commissioner Voelker, yes and Judge Drees, yes.

 

Ordinances

 

Ordinance No. 950.86

Second reading of an ordinance to adopt the International Property Maintenance Code and authorizing the Northern Kentucky Area Planning Commission, One Stop Shop, to enforce the provisions of same, Stacy Hege reporting:  This will adopt the 2006 version of this code.  Judge Drees asked why this was labeled as the international code instead of national and Ms. Hege said she assumed that it is applied on an international basis and not just in the United States.  Mr. Frye said the real reason for this is that it includes Canada.

 

Commissioner Voelker made the motion for approval; seconded by Commissioner Knochelmann and the motion unanimously passed with a roll call vote of Commissioner Voelker, yes; Commissioner Knochelmann, yes and Judge Drees, yes.

 

Ordinance No. 924.38

Second reading of an ordinance adopting the uniform state building code as promulgated in 815 KAR 7:120 and 125 by the Board of Housing, Buildings and Construction of the Commonwealth of Kentucky, Stacy Hege reporting:  This is a standard ordinance adopting the state building code.  Commissioner Knochelmann made the motion to accept with a second from Commissioner Voelker.  The motion unanimously passed with a roll call vote of Commissioner Knochelmann, yes; Commissioner Voelker, yes and Judge Drees, yes.

 

Consent Agenda

 

Claims List-County Treasurer Ivan Frye:  Judge Drees said there being no questions on the claims list, warrants will be issued and all bills will be paid.

 

Administrative Actions

 

Handout No. 07-50

Recommendation of the Judge Executive to approve an amended term order from Kenton County Sheriff, Charles Korzenborn:  Deputy Sheriff Pat Morgan said that Sheriff Korzenborn was out of town to a conference.  Judge Drees said this was a revised term order so a vehicle can be bought for the transportation of prisoners.  Mr. Morgan said the bus that is currently being used was donated by TANK and needed to be replaced because of the condition of the vehicle.  The sheriff's office will go to a transport van to move a lot of prisoners between Kenton County, prisons, to mental health facilities and the court.

 

Commissioner Voelker said she would like to make a motion for approval with the caveat that this vehicle is serviced and receives all maintenance from the county garage.  Mr. Morgan said he would pass this on to the sheriff and it should, hopefully, be under warranty for a couple of years.  Commissioner Knochelmann said he would second the motion and asked if the usual vehicles from TANK for transportation were not working.  Mr. Morgan said they were large, carry approximately 20 persons and may sit idle for one to two weeks and the van could be put to better use.  Judge Drees asked for a roll call vote whereupon the following votes were counted:  Commissioner Voelker, yes; Commissioner Knochelmann, yes and Judge Drees, yes.

 

Handout No. 07-51

Request approval of change order number one from Zcon Construction, LLC in the amount of $10,586.00 bringing the total for the project to $98,339.00.  The changes have been requested and approved by Garland VanHook of the Administrative Office of the Courts:  Judge Drees said this is another job that is performed by the county and gets paid back through the state.  Commissioner Knochelmann made the motion to accept; seconded by Commissioner Voelker.  There being no further discussion or questions, Judge Drees asked for a roll call vote:  Commissioner Knochelmann, yes; Commissioner Voelker, yes and Judge Drees, yes.

 

Handout No. 07-52

Requesting permission to purchase a salt spreader and shoulder machine from J. Edinger & Son as a sole source vendor, Ivan Frye reporting:  J. Edinger & Son sells to the state on price contract and there is a cheaper unit that is strictly a salt spreader.  It was found this device could save man hours in the public works department and the county is in favor of buying it from them even though it is slightly higher than the purchase of a single unit.  Commissioner Knochelmann made the motion for approval followed by a second from Commissioner Voelker and the motion was unanimously approved with the roll call vote of Commissioner Voelker, yes; Commissioner Knochelmann, yes and Judge Drees, yes.

 

Handout No. 07-53

Requesting permission to purchase turf equipment from Xenia Power Equipment under state contract pricing, Ivan Frye reporting:  This is asking for approval for eight mowers for the golf courses to replace nine units that are currently not reliable.  Commissioner Voelker asked how long the current mowers had been in use and Mr. Frye said the times vary staring with 1988 and the newest mower was bought in 1998.  Judge Drees asked if this was a one time payment and Mr. Frye answered no that one payment would be made out of the CDBG fund of $211,000 and the golf courses will repay this in four equal installments beginning in the next budget year.

 

Commissioner Voelker made the motion for approval; seconded by Commissioner Knochelmann.  Judge Drees asked if there were questions and Commissioner Knochelmann said he noticed that one will be a loaner for three years and asked Mr. Frye to explain this.  Mr. Frye said this was a unit that is designed to verticut that the county does not currently own and we are not buying this one.  They are going to give the county one as a demo unit and it will be used for a year at a time and turned back into them and sold.  They will provide the county with another one to use up to 150 hours per year.   Judge Drees asked for a roll call vote and the motion unanimously passed with Commissioner Knochelmann voting yes; Commissioner Voelker voting yes and Judge Drees voting yes.

 

Handout No. 07-54

Requesting permission to purchase a loader in the Kenton County Department of Fleet Management, Ivan Frye reporting:  This is a piece of equipment that needs to be replaced.  There is a unit at the department that is being used as a demo and the court is being asked to approve the unit in the amount of $98,500.00.  Used units were looked at and it was determined that the value of the dollar on the used equipment that could be found on the market was not there and the county was better off in the long term buying new equipment.

 

Judge Drees asked if this would come back to the county and Mr. Frye answered no and asked the court to add this to the motion.  Commissioner Knochelmann made the motion to accept; seconded by Commissioner Voelker and the motion unanimously passed with a roll call vote of Commissioner Voelker, yes; Commissioner Knochelmann, yes and Judge Drees, yes.

 

Handout No. 07-55

Concurring in determination to remove gasoline equipment, island and bumper post and break out concrete over fiberglass gasoline tank at the Kenton County Police Department:  Mr. Frye said this is the removal of a gas tank that has not been used for almost a year.  It is across the road and the land is going with the building the county is selling and needs to be taken out.  There is a proposal to do this for an amount of $9,850.00.  Commissioner Knochelmann made the motion for approval followed with a second from Commissioner Voelker.  The motion unanimously passed with a roll call vote of Commissioner Knochelmann, yes; Commissioner Voelker, yes and Judge Drees, yes.

 

Executive Orders

 

Executive Order No. 07-81

Reappointment of Ronald Dill, Darren Moore and David Stephenson to the Building Appeals Board for a two-year term, effective June 26, 2007:  Commissioner Knochelmann made the motion for approval; seconded by Commissioner Voelker and the motion unanimously passed with a voice vote of aye.

 

Executive Order No. 07-82

Appointment of Thomas Miller to the Building Appeals Board for a two-year term, effective June 26, 2007:  Commissioner Knochelmann made the motion for approval; seconded by Commissioner Voelker and the motion unanimously passed with a voice vote of aye.

 

Executive Order No. 07-79

Employment of Joseph Martinez as a park trustee for the Department of Parks and Recreation, effective June 21, 2007:  Commissioner Voelker made the motion for approval; seconded by Commissioner Knochelmann and the motion unanimously passed with a voice vote of aye.

 

Executive Order No. 07-80

Employment of Daniel Rebilas as part-time maintenance for the Kenton County Golf Courses:  Commissioner Knochelmann made the motion for approval; seconded by Commissioner Voelker and the motion unanimously passed with a voice vote of aye.

           

Citizens Address

 

There were not any citizens present that wished to address the court.

 

Administrative Reporting:

 

DEPUTY JUDGE EXECUTIVE-Scott Kimmich:  Absent-out of town.

 

COUNTY TREASURER-Ivan Frye:  Nothing further to report.

 

HUMAN RESOURCES DIRECTOR-Joe Shriver:  Nothing to report.

 

COUNTY ATTORNEY'S REPORT-Stacy Hege:  Nothing to report.

 

Commissioners' Reports

 

COMMISSIONER DAN HUMPERT-Absent-out of town.

 

COMMISSIONER SARA VOELKER-Said that in relation to the maintenance on the vehicle at the county garage that was mentioned, she would like the record to show that the county should move forward in talking with the sheriff's department in centralizing all of the maintenance on the vehicles.  Judge Drees said when the sheriff gets back into town, there could be a meeting to discuss this.

 

COMMISSIONER KRIS KNOCHELMANN-He said he was not present at the last meeting and that obviously Jerry Knochelmann is a relation of his, and he looks forward to his coming to work for the county.  He said he also wanted to make the note that in the six months he had to deal with Ivan Frye, that it has been a joy to work with him. 

 

Judge-Executive's Report

 

Judge Drees said he wanted to go through the jail sites and asked Commissioner Knochelmann to go through the list.  Commissioner Knochelmann said that week after next the group would get together to be shown data on Webster and Crestview Hills as to why they were removed from the list.  Data would also be shown on Mary Laidley and West Grand as the other potential sites.  Judge Drees said a price was to be received on one of the pieces of land today but Commissioner Knochelmann said the person had not called to give the price.  Judge Drees said the county has engineering numbers but does not have any land prices. 

 

Executive Session

 

There was no executive session called.

 

Adjournment

 

There being no further business to come before the court, Judge Dress asked for a motion for adjournment.  Commissioner Voelker made the motion; seconded by Commissioner Knochelmann, and the court was adjourned with the unanimous voice vote of aye.
