Regular Meeting
JANUARY 8, 2008, 9:00 A.M.
Call to Order
Judge-Executive Ralph Drees called to order the regular meeting of the Kenton County Fiscal Court with the following individuals in attendance: Judge Ralph Drees, Commissioner Dan Humpert, Commissioner Kris Knochelmann, Commissioner Sara Reeder-Voelker, County Attorney Garry Edmondson, Deputy Judge Scott Kimmich, County Treasurer Jerry Knochelmann, Chief of Police Col. Ed Butler, County Road Superintendent Joe Murphy, and Special Projects Manager Ralph Bailey.
Guests in the courtroom were Sheriff Charles L. Korzenborn, Chief Deputy Sheriff Pat Morgan, Deputy Sheriff/Comptroller Richard Searles, Chief Deputy County Clerk Dan Miles, and County Jailer Terry Carl.
Invocation and Pledge of Allegiance
Judge Drees called upon Commissioner Dan Humpert who offered the invocation and led in the pledge of allegiance.
Approval of Minutes
Judge Drees presented the minutes for the approval of the court. Commissioner Humpert confirmed there were two sets of minutes and Deputy Judge Kimmich advised that this was correct.
Commissioner Humpert moved approval of the minutes of the regular meeting held on December 11 and the special called meeting on December 27, 2008, and Commissioner Knochelmann seconded the motion. There being no further discussion of the motion before the court, Judge Drees called for a voice vote whereupon all members present voted in the affirmative.
General Business
Sheriff's Term Order:
Judge Drees presented for the review and/or action by the court the Kenton County Sheriff's General Term Order for Calendar Year 2008. In presenting the document, Judge Drees expressed his appreciation to the sheriff and his staff for the cooperation they had demonstrated in working with County Treasurer Knochelmann in developing a budget that was good for the county.
County Sheriff Korzenborn expressed his appreciation to the treasurer and then reviewed the term order with the fiscal court providing for the expenditure of $3,463,260.92 for the upcoming fiscal year.
Commissioner Voelker reaffirmed her desire that all vehicles in the county fleet, including those of the sheriff be maintained at the county garage. Sheriff Korzenborn confirmed that this was the case and said he was pleased with the service and that he was watching costs on this issue just as he does others in his office to insure efficiency.
A brief discussion ensured after which a motion was offered by Commissioner Knochelmann and seconded by Commissioner Reeder-Voelker to approve the general term order in the amount of $3,463,260.92 as requested by the sheriff and recommended by the county judge and county treasurer. There being no further discussion of the motion before the court, Judge Drees called for a roll call vote whereupon all members present voted in the affirmative.
Clerk's Term Order:
Judge Drees presented the term order of the Kenton County Clerk for Calendar Year 2008 and expressed his appreciation to the clerk and his staff for working cooperatively with the treasurer in preparing this budget.
Chief Deputy County Clerk Dan Miles presented the clerk's term order for consideration of the county in the amount of $2,534,001.00.
A brief discussion ensured after which a motion was offered by Commissioner Knochelmann and seconded by Commissioner Reeder-Voelker to approve the general term order in the amount of $2,534,001.00 as requested by the clerk and recommended by the county judge and county treasurer. There being no further discussion of the motion before the court, Judge Drees called for a roll call vote whereupon all members present voted in the affirmative.
Resolutions
Resolution No. 08-01-A
A resolution recommending adjustments between appropriation accounts to provide necessary funding for items identified on the attached schedule.
Judge Ralph Drees presented to the court the resolution as recommended by the County Treasurer Jerry Knochelmann.
Mr. Knochelmann explained that this adjustment is needed to provide sufficient revenue to provide for the payment of water bills at the golf course.
A motion was offered by Commissioner Knochelmann and seconded by Commissioner Humpert to approve resolution 08-01-A. There being no further discussion of the motion before the court, Judge Drees called for a roll call vote whereupon all members present voted in the affirmative.
Ordinances
Ordinance No. 924.43
First reading of an ordinance amending zoning for an approximate 10 acres of a 105 acre area located at the Southeast corner of the intersection of Taylor Mill Road with Manor Lake Drive from R-1B and A-1 to R-1B.
Judge Ralph Drees presented for first hearing of Ordinance 924.43. Garry Edmondson advised that he would recommend the first reading be placed upon the record. No vote is required and a representative of the Kenton County & Municipal Planning and Zoning Commission and a staff member of the Northern Kentucky Area Planning Commission be present for a report at the second reading.
Commissioner Humpert said this was fine with him, but he wanted the developer put on notice that the court did reserve the right to deny passage on second reading.
Claims List
Judge Drees presented the claims list dated January 4, 2008, for review by the commissioners. Commissioner Knochelmann questioned whether the education assistance as noted on page nine is available to all county employees. Judge Drees called on Human Resources Director Joe Shriver who advised that this is available to all students and that the county pays the hourly rate that is in place at Northern Kentucky University.
Judge Drees advised this is consistent with the personnel policies which are all currently under review and which have been altered a number of times in recent years.
There being no further questions or concerns the Judge advised warrants will be issued and the claims will be paid.
Administrative Actions
Handout No. 08-01
Request approval of awarding of contract to remove and install a new uninterruptible power supply system (UPS) to the lowest bidder, Engineering Dynamics.
Judge Drees presented Handout No. 08-01, a recommendation of the county treasurer, to award the bid. Mr. Knochelmann advised this is a budgeted item and Chief Ed Butler advised the court that the previous UPS unit had been in place for 11 years when it failed. Although the agency has a generator, the UPS protects the integrity of the system between the time the power fails and the generator becomes functional.
Chief Butler also confirmed in discussion with Judge Drees that the recommended vendor is the firm which provided the previous unit and they have familiarity with the current structure at the center.
A motion was offered by Commissioner Knochelmann and seconded by Commissioner Humpert to accept the bid, approve the purchase and proceed with installation. There being no further discussion of the motion before the court, Judge Drees called for a roll call vote whereupon all members present voted in the affirmative.

Personnel
Executive Order 08-01
Request approval of the resignation of Anthony Duncan, effective January 4, 2008.
Judge Drees presented the executive order for consideration of the court. A motion was offered by Commissioner Humpert and seconded by Commissioner Knochelmann to ratify the order. There being no further discussion of the motion before the court, Judge Drees called for a voice vote whereupon all members present voted in the affirmative.
Executive Order 08-02
Request approval of the resignation of Tim Scheidt, effective September 30, 2007.
Judge Drees presented the executive order for consideration of the court. A motion was offered by Commissioner Reeder-Voelker and seconded by Commissioner Knochelmann to ratify the order. There being no further discussion of the motion before the court, Judge Drees called for a voice vote whereupon all members present voted in the affirmative.
Executive Order No. 08-03
Approval of Raina Vicars to the position of police officer in the Kenton County Police Department, effective January 23, 2008.
Judge Drees presented the executive order for consideration of the court. A motion was offered by Commissioner Reeder-Voelker and seconded by Commissioner Knochelmann to ratify the order. There being no further discussion of the motion before the court, Judge Drees called for a voice vote whereupon all members present voted in the affirmative.
Executive Order No. 08-04
Approval of Laura Salzman as acting fiscal court clerk, effective December 27, 2007.
Judge Drees presented for the executive order for consideration of the Court. A motion was offered by Commissioner Humpert and seconded by Commissioner Knochelmann to ratify the order. There being no further discussion of the motion before the court, Judge Drees called for a voice vote whereupon all members present voted in the affirmative.
Executive Order No. 08-05
Request approval of the reorganization of the golf courses of reduction of the maintenance staff.
Judge Drees presented the executive order for consideration of the Court. A motion was offered by Commissioner Knochelmann and seconded by Commissioner Reeder-Voelker to ratify the order. There being no further discussion of the motion before the court, Judge Drees called for a voice vote whereupon all members present voted in the affirmative.
Executive Order No. 08-06
Request approval for the resignation of Tom Mackie for retirement, effective March 1, 2008.
Judge Drees presented the executive order for consideration of the Court. A motion was offered by Commissioner Reeder-Voelker and seconded by Commissioner Humpert to ratify the order. There being no further discussion of the motion before the court, Judge Drees called for a voice vote whereupon all members present voted in the affirmative.

County Attorney's Report
Garry L. Edmondson wanted to request the court to retire to executive session at the appropriate time on the agenda.
Commissioners' Reports
Dan Humpert expressed surprise that a year has passed with the new court and his appreciation for a good year.
Sara Reeder- Voelker- Wanted to remind the voters of the 63rd Legislative District to get out and vote today.

Judge-Executive's Report
Judge Ralph Drees advised the court that the county has sought and received proposals for geotechnical studies at the proposed site for the jail and that Thelen has come in about $5,000 cheaper than Nutting. He also explained that Thelen has done work for the current landowners and that this may have been part of the reason the costs are so much lower.
Judge Drees requested the court to accept the Thelen proposal in the amount of $19,248.75 and authorize him to finalize negotiations and enter into a contract upon review as to form and classification by the county attorney.
Commissioner Kris Knochelmann moved approval of the Judge's request and Commissioner Humpert seconded the motion. There being no further discussion of the motion before the court, Judge Drees called for a voice vote whereupon all members present voted in the affirmative.
Executive Session
Judge Drees requested the court retire to executive session. Deputy Judge Kimmich advised the court would need to move to retire to executive session pursuant to KRS 61.810 (1)(b)(c)(f).
Mr. Kimmich explained that the executive session would be to discuss land acquisition located in the general vicinity of Mary Laidley Road for the purposes of constructing a new detention center, to discuss the case of Wilson –v- Kenton County, and for the purpose of discussion concerning an individual personnel matter.
Commissioner Humpert moved approval of the request for executive session and Commissioner Reeder-Voelker seconded the motion. There being no further discussion of the motion before the court, Judge Drees called for a voice vote whereupon all members present voted in the affirmative.
Following the executive session, Judge Drees requested a motion to return to open session.
Commissioner Knochelmann moved approval of the request to return from executive session; Commissioner Humpert seconded the motion. There being no further discussion of the motion before the court, Judge Drees called for a voice vote whereupon all members present voted in the affirmative.
Judge Drees requested a motion to proceed in the payment of $17,135.80 for plaintiff's legal fees in the case of Wilson –v- Kenton County as order by U. S. District William Bertelsman.
Commissioner Humpert moved approval of the request to proceed in the payment of $17,135.80 and Commissioner Knochelmann seconded the motion. There being no further discussion of the motion before the court, Judge Drees called for a roll call vote whereupon all members present voted in the affirmative.
County Attorney Edmondson advised the court that he felt it would be appropriate for the court to formally authorize, again, his office to proceed in the filing of condemnation of properties previously identified for the location of the county detention center. He acknowledged that it was his recollection this had been done in a previous meeting but simply felt it would be best to clarify it before he takes formal action.
Commissioner Humpert moved approval of the request of the county attorney that he be authorized to take legal action in the condemnation of property generally located in the vicinity of Mary Laidley Drive for the construction of a new county detention center. Commissioner Knochelmann seconded the motion.
There being no further discussion of the motion before the court, Judge Drees called for a roll call vote whereupon all members present voted in the affirmative.
Adjournment
Advising that all matters before the court had been dealt with, Judge Drees advised he would entertain a motion to adjourn the meeting. Commissioner Humpert moved to adjourn and Commissioner Reeder-Voelker seconded the motion. The motion to adjourn being non-debatable, Judge Drees requested a voice vote whereupon all members presented voted in the affirmative and the meeting was adjourned.
