JANUARY 6, 2004
Judge Murgatroyd called the regular meeting of the Kenton County Fiscal Court to order at 7:07 p.m. Present were Commissioners Dan Humpert and Adam Koenig; Deputy Judge-Executive Scott Kimmich; County Attorney Garry Edmondson; Assistant Attorney Brandon Voelker; County Treasurer Ivan Frye; County Police Chief Bill Dorsey; Emergency Management Director Ed Burk; County Clerk Bill Aylor; Jailer Terry Carl; Interim Animal Shelter Director Dan Evans; and Court Reporter Cathy Johnston.
Commissioner Barbara Black was not in attendance because of illness.
The invocation and pledge of allegiance was led by Commissioner Dan Humpert
MINUTES
Approval of the minutes for the last meeting was tabled because they were not yet completed.
DELEGATIONS
There were no guests present to speak under delegations.
FINANCIAL AND BUDGET
Handout No. 04-001-Approval of Kenton County Clerk's budget for 2004, County Clerk Bill Aylor, reporting: There is a general term order that lists the receipts of calendar year 2002. The actual receipts for 2003 are not ready because the December report has not been completed. It is thought we will have a surplus entering 2004 of $150,000 that gives us an operating budget of $2,675,000. It is being asked that the fiscal court approve a budget that consists of a little over $2,000,000 in salaries, $300,000 for office expenses and $80,000 in equipment. Salaries are broken down on page two which is an increase of $63,000 from last year and this is about a four percent increase. The total payroll cost is $2,097,000 with fringe benefits, retirement, etc., which is an increase of $82,298 from the previous year. On page three is a breakdown from 1999 that was the beginning of the previous term up to 2002 with the estimated budget of 2004 with 2003, and the appropriate increases for receipts and salaries and fringe benefits.
Commissioner Humpert asked Ivan Frye if, as far as the projections from last year and this year go, are we pretty much on target?
Treasurer Frye answered yes, that this is a solid budget and is as accurate as can be based on a review of month-by-month with Mr. Frye and Mr. Aylor.
Mr. Aylor said no large changes were expected in revenue unless something is changed in the legislature, and at this point, nothing is anticipated. More equipment has been included than is anticipated.
Commissioner Humpert made the motion to approve the budget with Commissioner Koenig's second.
Following roll call, the budget was unanimously approved.
Mr. Aylor said that on behalf of his office, he would like to personally thank the Judge for his professionalism, on the courtesy extended to him and his employees and the service he has given to the people of Kenton County.
Handout No. 04-002-Approval of Kenton County Sheriff's budget for 2004, Sheriff Korzenborn, reporting: Estimated receipts on the term order are $2,746,240. In the year 2002, it was $2,495,960 and for 2003, $2,631,00. Ninety-five percent of taxes have been collected due out of $81.4 million this year. The sheriff estimated his 75 percent fees will be greater than those expenses requested. We had a surplus this year of $315,000 and the estimated funds for the calendar year 2004 are $3,061,240. The salaries and the employers share of FICA and retirement insurance amount to $2,422,063 which is about a two percent increase on salary. The reason the budget is showing more is because we had some salaries we did not use because some personnel positions were not filled. Regular office expenses are $280,000 and equipment is $43,577 for a total of $2,746,240. This budget is respectively submitted for consideration.
Judge Murgatroyd asked for questions or comments.
Commissioner Humpert said the same question would go to Mr. Frye for this budget. Were the projections for 2003 budget in the ballpark and are the projections for 2004 an accurate projection?
Mr. Frye said he was told that the 2003 figures were within $30,000 of the number now and he had not seen those numbers, and if 2003 is okay, 2004 will be.
Commissioner Humpert also asked if the surplus figure of $315,000 was accurate?
Mr. Frye said this would not be known until February when the final reports are received.
Sheriff Korzenborn said nothing was spent unless it comes through his office with a purchase order.
Commissioner Humpert said he was very impressed with the budget. He said the sheriff was asking for a four percent increase and, based on the 12 percent that was returned last year, shows that he is a good fiscal steward.
Commissioner Koenig said that this time last year we talked about warrants and a tracking system was put in and he would like to have an update.
Sheriff Korzeborn stated that throughout the past month 1,200 warrants had been served and this does not count all of the out of county warrants because all of those figures are not in.
Judge Murgatroyd asked the treasurer if he was okay with this budget. The treasurer responded in the affirmative.
Commissioner Humpert made the motion to approve the budget and Commissioner Koenig seconded the motion.
The motion unanimously passed following roll call.
Sheriff Korzenborn congratulated Judge Murgatroyd on his new appointment.
Judge Murgatroyd said it had been his pleasure to serve with all of the staff; especially, the sheriff's office.
Handout No. 04-003-Approval of payment for county tax bill preparation: For a total of 61,455 tax bills prepared for 30 cents each for a total of $18,436.50 with one-half being paid by the state for a total of $9,218.25 and office certification charge of $1.50 for a grand total of $9,219.75. Commissioner Koenig made the motion for approval; seconded by Commissioner Humpert.
The motion unanimously carried following roll call.
TREASURER'S REPORT
Treasurer Frye had nothing further to report.
OLD BUSINESS
There was no old business to come before the court.
NEW BUSINESS
Appointment of Scott Kimmich as Kenton County Representative to the OKI Board of Trustees and Steering Committee: Commissioner Humpert made the motion to approve the appointment; seconded by Commissioner Koenig. Following roll call, the motion unanimously passed.
Approval of Constable's official bond: Treasurer Frye said the constable's bond is annually renewable and requires fiscal court approval. He has to bring back payment to show his bond is still valid and the court approves it finding that the surety is adequate. It is in the amount of $10,000 with the Western Surety Company.
Commissioner Koenig made the motion to approve the bond with Commissioner Humpert seconding the motion.
The motion unanimously passed following roll call.
ORDINANCES
Ordinance No. 121.14-Second reading – An order establishing the Kenton County Fiscal Court meeting schedule for the 2004 calendar year, Deputy Judge Scott Kimmich reporting: Mr. Kimmich said this was the same schedule presented at the last meeting.
Commissioner Humpert made the motion the calendar be approved with Commissioner Koenig's second.
Following roll call, the motion unanimously passed.
Ordinance No. 121.15-Second reading – An ordinance adopting the Doe Run Lake Master Plan. Judge Murgatroyd made the announcement that we were supposed to have a presentation but it would not be offered because Commissioner Black was absent. The presentation will be seen on next Tuesday morning at the court meeting.
Commissioner Humpert made the move to table with Commissioner Koenig's second.
The motion unanimously carried following roll call.
RESOLUTIONS
Resolution No. 04-01-Naming of the road in front of the Kenton County Department of Public Works be named as Bob Krohman Drive and signs indicating same be installed Deputy Judge Kimmich, reporting: A proclamation was read by Mr. Kimmich stating Mr. Krohman's years of service to the county and how well he served with high distinction in order to help improve the quality of life of the citizens of Kenton County. The proclamation was to serve as the first reading of an ordinance to legally change the name of the roadway
Commissioner Koenig made the motion that the proclamation be accepted; seconded by Commissioner Humpert.
The proclamation was unanimously approved following roll call.
EXECUTIVE ORDERS
Executive Order No. 04-01-Appointments to the Kenton County Extension Board, Mr. Kimmich, reporting: Asked the court for the appointments of Mary Cox and Mary Helen Clare to continue to serve on the Kenton County Extension Board for a three-year term.
It was moved by Commissioner Humpert to make the appointments with Commissioner Koenig's second.
The appointments were unanimously approved following roll call.
CITIZEN ADDRESS
There were no citizens present to address the court.

Commissioner Koenig-When we lost Bob Krohman we lost a great man, a good employee, a good guy and it says everything when you see him put to rest in his Kenton County shirt. During his 27th year, I asked him if he was going to retire and he said no, but did retire and came back. I told him when I retired, you could find me on the golf course. He loved his job, the people of Kenton County and the people he worked with and this kind of tells you all you need to know about him.
EXECUTIVE SESSION
The motion was made and seconded to go into executive session at 7:30 p.m. Judge Murgatroyd requested a motion to return from executive session. Commissioner Koenig moved approval of the recommendation and Commissioner Humpert seconded the motion. There being no further discussion, Judge Murgatroyd directed that the clerk call the roll whereupon all members vote aye. Motion carried.
Judge Murgatroyd presented Executive Order 04-02 for ratification accepting the resignation of Aline Summe as Director of the Kenton County Animal Shelter. Commissioner Koenig moved approval of the order and Commissioner Humpert seconded the motion. There being no further discussion, Judge Murgatroyd directed that the clerk call the roll whereupon all members vote aye. Motion carried.
Judge Murgatroyd recommended that the fiscal court accept the recommendation of the County Attorney and County Treasurer that the county accept the bid of $2,300 from William P. and Mary Sue Butler for a parcel of property located adjacent to their property along Bromley-Crescent Springs Road, with the condition that the purchaser pay all fees associated with surveying the site and preparation of the deed. Commissioner Humpert moved approval of the recommendation as submitted and Commissioner Koenig seconded the motion. There being no further discussion, Judge Murgatroyd directed that the clerk call the roll whereupon all members vote aye. Motion carried.
Judge Murgatroyd requested a motion of the court accepting his determination that there is a need for a county administrator, and further accepting the determination reached by both the County Judge and County Treasurer that this is a unique position. Therefore, it should be handled as a sole source contract under the provisions of Kenton County Procurement Policies. Commissioner Humpert moved approval of the recommendation as presented and Commissioner Koenig seconded the motion. There being no further discussion, Judge Murgatroyd directed that the clerk call the roll whereupon all members vote aye. Motion carried.
Judge Murgatroyd recommended that the Kenton County Fiscal Court move to enter into a contract for professional services with Richard S. Kimmich, Erlanger, Kentucky, to serve as county administrator in and for the County of Kenton, Kentucky, for a period to commence January 7 and terminating on December 31, 2006. Commissioner Koenig moved to enter into the contract as recommended and Commissioner Humpert seconded the motion. There being no further discussion, Judge Murgatroyd directed that the clerk call the roll whereupon all members vote aye. Motion carried.
