MINUTES
JANUARY 27, 2004
Judge Ralph A. Drees called the meeting of the Kenton County Fiscal Court to order at 7:03 p.m. Present at the meeting were Commissioners Adam Koenig, Barbara Black and Dan Humpert; Deputy Judge and Chief of Staff Scott Kimmich; County Finance Officer Ivan Frye; County Attorney Garry Edmondson; Kenton County Police Chief Bill Dorsey; Golf Courses Director and Pro Tom Mackie; Interim Animal Shelter Director Dan Evans; Jailer Terry Carl; Sheriff Charles Korzenborn; Assistant County Attorney Brandon Voelker; Court Reporter Cathy Johnston and guests.
The invocation and pledge of allegiance was led by Commissioner Black.
MINUTES
It was decided to dispense with the approval of the minutes of January 13, 2004, because of the lateness of them being received. This approval will be taken up at the next meeting.
DELEGATIONS
There were no presentations listed on the agenda.
FINANCIAL AND BUDGETS
Judge Drees announced that everyone had a copy of the claims list and Mr. Ivan Frye would be reporting.
Mr. Frye said the claims list was there for the court's consideration and if there were any questions, he would be happy to answer them. The claims list is a list of invoices and bills that are due for payment and is brought to the court for their consideration. There is actually no vote to approve, but if there is an objection to a claim on the list, the item is usually pulled and researched. If there is an argument over a claim, it would take a majority rule not to pay a claim. The claims as presented on the list are always within budget and are legal obligations of the county.
The Judge asked if there were any questions and Commissioner Black said on page five there were a lot of charges for the Kentucky Transportation Center for either $140.00 or $210.00 and wanted to know what these charges were for. Mr. Frye answered that these charges were for courses that road employees are sent to, usually management employees, and the charges were different because they attend different classes. The university has a contract with the Kentucky Transportation Department and they conduct training for county employees around the state and we get a lot of training for a very economical price and gain expertise in different areas.
Mr. Frye said the monthly report was presented last month and the quarterly report has also been prepared and will be put in the minutes, and has been forwarded to the State Local Finance Officer.
Mr. Frye had no further comments for the court.
OLD BUSINESS
There was no old business to come before the court.
NEW BUSINESS
HANDOUT NO. 04-04-Accept bid submitted by Manning Equipment for dump bodies, plows and sanders to be used by Public Works, Ivan Frye reporting: These are bids that were taken for the second time. The first time there was confusion over what we were asking for, and this time there is no confusion and the lowest and best bid for the county is being recommended as Manning Equipment.
Judge Drees asked for questions. There being none, Commissioner Koenig made the motion to accept the bid with Commissioner Black's second. The motion passed unanimously with roll call.
HANDOUT NO. 04-05-Accept bid submitted by Copper Cettle for golf courses concession service, Ivan Frye reporting: The method of bidding was changed. There used to be a percentage arrangement and the bid was awarded to the concession service that offered the highest percentage of sales to us. It was decided that it was easier to measure and do bookkeeping if a flat amount was settled on, and we asked the bidders to bid a flat amount they would award the county to provide this service, so we are awarding this service to the highest bidder. The court is being asked to approve this bid.
Judge Drees asked if the Copper Cettle was new. Mr. Frye said they had done business before and were experienced in catering. They had gone out of business and now were going to reinstitue this service for the county.
The Judge entertained a motion to approve. Commissioner Humpert moved for approval with Commissioner Black seconding the motion. There being no questions, the submitted bid was unanimously approved.
HANDOUT NO. 04-06-Accept bid submitted by Custom Design Benefits, Inc. for third party administration services relating to the county's medical plan and stop loss coverage, Ivan Frye reporting. It is recommended the court approve the award to Custom Design Benefits. Bids were taken and interviews were conducted. Twelve bids were started with which were narrowed down to five who were interviewed and then narrowed down to three who were also interviewed. These were narrowed down to two who were negotiated with and the best bid available is that of Custom Design Benefits which is a change from UMR who was the other finalist. Custom Design offered a savings of $20,000 over what UMR was offering and they are also offering better and quicker responsive service for the program to be administered as well as online information to employees who can check on their own plans. It is thought this is a much better arrangement than what is now available to employees.
Deputy Judge Kimmich said it should also be pointed out that we are not changing insurance. We are still self-insured and the level of benefits to the employees is not changing. This is simply a change to who will administer the program on our behalf.
Mr. Frye also said this timing is actually 60 days before the plan would go in place and an employee should still present their UMR card until they receive a new medical benefits card. There will be a briefing and the cards will be personally handed out to all employees so there is no misunderstanding which will be scheduled later in the month of March before this goes into effect on April 1.
The Judge entertained a motion to approve. Commissioner Koenig made the motion to approve; seconded by Commissioner Humpert. The motion was unanimously approved following roll call.
HANDOUT NO. 04-07: Authorize County Judge-Executive Ralph A. Drees to sign a contract extension with Mobilcomm, Inc. for radio repair services to mobile and portable subscriber units for one year.
Commissioner Humpert asked if this group would also do the new mobile data terminals or would this be a separate contract.
Mr. Kimmich answered this would be under a separate service contract. This is for equipment in service at the present time.
Commissioner Black asked if there was satisfaction with the service currently being received.
Chief Dorsey answered in the affirmative and this is the only company that can satisfactorily service the account.
Judge Drees asked if there were further questions, and there being none, entertained the motion for approval. Commissioner Humpert moved the contract be accepted with Commissioner Black's second. The motion was unanimously approved following roll call.
Judge Drees said the next item, Thelen & Associates be declared sole source provider for geo-technical services, was removed from the agenda and asked Mr. Kimmich for further comments.
Mr. Kimmich said it had been internally discussed about issuing a sole source provider contract to Thelen & Associates for geo-technical work that had been done on the road slides in the county. While talking with Attorney Edmondson and Commissioner Black earlier, it is thought that this is not a sole source and that another contractor could come in and take the preliminary work that has been done and move forward or do their own work at their own cost if they were not willing to accept the reconnaissance report that is in place. Therefore, the recommendation is being withdrawn to go to a sole source and we will be meeting with the Public Works Director to establish a bidding package we can bring back to the court in the near future.
ORDINANCES
There were no ordinances to come before the court.
RESOLUTIONS
RESOLUTION NO. 04-02: Authorizing a grant application for cemetery preservations funds to be used at Linden Grove Cemetery and execution of the grant. Judge Drees announced we will be receiving $25,000 from the state and the county is matching this amount.
Mr. Frye said this is no increase for the county because we are already putting up $25,000 this year for our share.
There were no questions so the Judge asked for a motion. Commissioner Humpert moved the authorization be accepted with Commissioner Koenig's second. Authorization was unanimously approved following roll call.
RESOLUTION NO. 04-03: Authorizing an application to use area development grant funds or partial funding for the county mobile data terminal project, Mr. Kimmich reporting-This is annual funding received from the state that is passed through the Area Development District. The total funding for this biennium was $91,065 and we are requesting to use this amount to offset the cost of mobile data terminals. This will benefit all 20 cities and fire departments in the county so it is a community wide benefit.
Commissioner Humpert said he did not understand the language in the resolution "or partial funds." Mr. Kimmich said it should read "of partial funding" for the county……
Commissioner Black said while looking through the project it is believed we are applying all of the money we normally get. Should we get the additional grant with the cities listed or where is the money for the remainder coming from?
Mr. Kimmich said when you look at the project profile sheet, it shows we have already received $1,000,000 in federal funding and $91,065 in ADF funding, leaving a balance of $2,468,935. We will pay those proceeds from the bond that was issued, and based on the number of units that each city receives, they will pay back over five years the costs of the MDTs.
Commissioner Black asked for confirmation of parceling the units out according to how the cities are using them. Mr. Kimmich answered in the affirmative.
Commissioner Black made the motion approving the authorization with Commisisoner Humpert's second. Authorization was unanimously approved upon roll call.
EXECUTIVE ORDERS
EXECUTIVE ORDER NO. 04-08: Judge Drees ordering the appointment of Scott Kimmich as Deputy Judge-Executive effective January 16, 2004.
EXECUTIVE ORDER NO. 04-09: Judge Drees' order that the flags of all Kenton County Fiscal Court facilities remain at half mast in recognition of the service of former Kenton County Sheriff Bill Steenken to honor his passing.
EXECUTIVE ORDER NO. 04-10: Judge Drees ordering the termination of Andrea Lear as a seasonal employee of the Kenton County Animal Shelter.
Commissioner Black made the motion the order be accepted with a second by Commissioner Humpert. The motion was unanimously accepted upon roll call.
CITIZEN ADDRESS
No one signed up for citizen address.
STAFF REPORTS
Deputy Judge Kimmich-Had no report but asked for executive session at the end of the meeting to discuss litigation and land acquisition and/or sale at conclusion of the business of the meeting.

COUNTY ATTORNEY REPORT
Attorney Edmondson-Nothing to report.
COMMISSIONERS REPORTS
Commissioner Humpert-No report, but welcomed the Judge to the court and said he did a great job.
Commissioner Black-Nothing to report but said the Judge may break her record in how fast he conducted the court meeting. She also welcomed the Judge and said that she was glad to see him there saying he was very expedient and got things done.
Commissioner Koenig-No report.
EXECUTIVE SESSION
The motion was made by Commissioner Humpert to go into executive session per KRS 61.810 B and C with Commissioner Black seconding the motion. Approval was unanimously given on roll call at 7:30 p.m.
Commissioner Humpert made the motion to come out of executive session with Commissioner Koenig's second. Motion unanimously carried.
ADJOURNMENT
Commisisoner Koenig made the motion to adjourn and Commissioner Humpert seconded the motion. Motion unanimously carried.
