KENTON COUNTY FISCAL COURT
FEBRUARY 26, 2008, 7:00 P.M.
Call to Order
Judge-Executive Ralph Drees called the meeting to order at 7:00 p.m. at the Independence Courthouse.
Those present included: Judge Ralph Drees, Commissioner Dan Humpert, Commissioner Kris Knochelmann, Commissioner Sara Reeder-Voelker, County Attorney Garry L. Edmondson, Deputy Judge Scott Kimmich, County Treasurer Jerry Knochelmann, County Police Chief Ed Butler, County Public Works Director Joe Murphy, and County Jailer Terry Carl.
Invocation and Pledge of Allegiance
Commissioner Dan Humpert led the court in the invocation and pledge of allegiance to the flag.
Approval of Minutes
Judge Drees presented for the court's consideration and approval of the minutes of the meeting held January 22, 2008. Commissioner Dan Humpert moved approval of the minutes as submitted and Commissioner Sara Reeder-Voelker seconded the motion whereupon Judge Drees called for a voice vote and all members presented voted in the affirmative.
General Business
Judge Drees recognized Tom Shomaker, Executive Director of the District Highway Office, for the Commonwealth's recommendation on the expenditure of the rural secondary funds for 2008.
Mr. Shomaker made his recommendation to the court and responded to an inquiry by Judge Drees by explaining that there was actually a slight increase in maintenance and repair funds this year for Kenton County. He also explained that there are potential alternatives for the expenditure of funds on Visalia Road. Those projects are listed on his report (copy attached) as projects 7-A and 7-B.
Mr. Shomaker advised the court that in the event a curve can be repaired to reduce accidents without having to expend significant funds, the work will be done and the remainder will be spent on resurfacing.
Commissioner Humpert expressed personal concern over the number of accidents along Visalia Road.
Deputy Judge Kimmich questioned whether it was the intent of the Commonwealth to maintain the current maintenance contract with the county for work performed on state roads in Kenton County. Mr. Shomaker advised that the Commonwealth is pleased with the relationship and anticipates no changes in the program this year.
Commissioner Dan Humpert moved to enter a resolution accepting and concurring in the recommendations of the district office for the rural secondary program. Commissioner Knochelmann seconded the motion and there being no further discussion, Judge Drees called for a roll call vote whereupon all members present voted in the affirmative.
Resolutions
Resolution No. 08-03
A resolution authorizing the filing of an application for funding from the 2008 waste tire market development crumb rubber grant program.
Commissioner Sara Reeder-Voelker moved approval of the resolution authorizing execution of the grant application. Commissioner Dan Humpert seconded the motion and there being no further discussion, Judge Drees called for a roll call vote whereupon all members present voted in the affirmative.
Resolution No. 08-04
A resolution authorizing the filing of an application for funding from the recreational trails program for $16,000 for Linden Grove Cemetery.
Commissioner Dan Humpert moved approval of resolution authorizing execution of the grant application. Commissioner Kris Knochelmann seconded the motion.
A discussion ensued as to whether this resolution and the next on the agenda, Resolution 08-05, was in conflict and whether we were filing two applications for the same pool of funding. Deputy Judge Kimmich advised that they are in fact the same pool of funds and that only one will be funded.
Judge Drees said he still thought it was worthwhile to file for both grants. The maker of the motion and the person making the second agreed to amend the motion to call for authorization of the Judge to sign both grant applications as set forth in Resolution 08-04 and 08-05.
Resolution No. 08-05
A resolution authorizing the filing of an application for funding from the recreational trails program for $30,000 in the Doe Run Lake area.
There being no further discussion, Judge Drees called for a roll call vote on the amended motion whereupon all members present voted in the affirmative.
Ordinances*
Ordinance No. 225.50
Second reading to amend Ordinance 225.48 imposing regulations and license taxes on franchises, trades, occupations, professions and other businesses in Kenton County.
Commissioner Sara Reeder-Voelker moved approval of Ordinance 225.50 on second reading. Commissioner Dan Humpert seconded the motion and there being no further discussion, Judge Drees called for a roll call vote whereupon all members present voted in the affirmative.
Consent Agenda
Operations
Claims List-Judge Drees presented the claims lists dated February 12, 2008 and February 26, 2008 for review by the court.
Judge Drees questioned the claim to Ben Wilson and was informed this was per diem for training reimbursement.
Judge Drees also questioned the payment of phone bills for the sheriff's office and was advised that this is reimbursed by the sheriff through an internal billing process.
There being no further questions, Judge Drees advised warrants will be issued and the claims will be paid.
Administrative Actions

Permission is requested to surplus three chairs in the Department of Kenton County Public Works.
Commissioner Sara Reeder-Voelker moved approval of the request. Commissioner Kris Knochelmann seconded the motion and there being no further discussion, Judge Drees called for a voice vote whereupon all members present voted in the affirmative.
Handout No. 08-07
Request authorization for Judge Executive Ralph A. Drees to sign a contract with H & N Safe Transportation Co. for transportation of pupils in St. Agnes School, Park Hills.
Commissioner Knochelmann inquired as to why this particular school is singled out and was advised that the other schools outside of Covington contract for service through the Kenton County schools and the county reimburses the school district.
Commissioner Sara Reeder-Voelker moved approval of the request. Commissioner Dan Humpert seconded the motion and there being no further discussion, Judge Drees called for a voice vote whereupon all members present voted in the affirmative.
Handout No. 08-08
Approval of quarterly report for the Kenton County Clerk's Office for calendar year 2008, Rodney Eldridge reporting.
It was agreed in the absence of the county clerk this issue will be placed on the next agenda for review and approval.

Executive Order No. 08-13
Appointment of Juanita Simmons to complete the term of Leon Myers on the Northern Kentucky Area Development District's Council on Aging, expiring June 30, 2008.
Commissioner Sara Reeder-Voelker moved confirmation of the order. Commissioner Kris Knochelmann seconded the motion and there being no further discussion, Judge Drees called for a voice vote whereupon all members present voted in the affirmative.
Executive Order No. 08-14
Request approval of an affiliation order for the Kentucky Search Dog Association to use fully trained dogs to search for missing or lost persons, deceased persons on land and in water, and disaster victims.
Commissioner Sara Reeder-Voelker moved confirmation of the order. Commissioner Kris Knochelmann seconded the motion and there being no further discussion, Judge Drees called for a voice vote whereupon all members present voted in the affirmative.
Executive Order No. 08-15
Reappointment of Robert Stegman to the Elsmere Fire Protection District for a three-year term, effective March 19, 2008.
Commissioner Kris Knochelmann moved confirmation of the order. Commissioner Dan Humpert seconded the motion and there being no further discussion, Judge Drees called for a voice vote whereupon all members present voted in the affirmative.
Executive Order No. 08-16
Appointment of Sean Mulligan to the Elsmere Fire Protection District to fill the unexpired term of Patricia Shawn, term to expire June 30, 2008.
Commissioner Dan Humpert moved confirmation of the order. Commissioner Sara Reeder-Voelker seconded the motion and there being no further discussion, Judge Drees called for a voice vote whereupon all members present voted in the affirmative.

Appointment of Charles Yates as equipment operator in the Department of Parks and Recreation, effective February 1, 2008.

Executive Order No. 08-12
Appointment of Ira Brockman and Nathaniel W. Sorrell as part-time technicians at the Kenton County Animal Shelter, effective January 23, 2008 and February 1, 2008, respectively.
Commissioner Kris Knochelmann moved confirmation of the order. Commissioner Sara Reeder-Voelker seconded the motion and there being no further discussion, Judge Drees called for a voice vote whereupon all members present voted in the affirmative.

Administrative Reporting
Deputy Judge-Executive- Scott Kimmich
ANIMAL SHELTER CHANGE ORDER: Deputy Judge Kimmich requested approval of the court of Change Order No. 1 on the Kenton County Animal Shelter which is reflective of changes required as the fire code is different for the facility than was originally anticipated by the architect. Deputy Kimmich informed the court that the county is working with the architect on potential recovery of some of the costs.
Commissioner Sara Reeder-Voelker moved approval of the change order on condition the county continue to pursue fees with the architect. Commissioner Kris Knochelmann seconded the motion and there being no further discussion, Judge Drees called for a roll call vote whereupon all members present voted in the affirmative.
DETENTION CENTER MEDICAL CONTRACT: Deputy Judge Kimmich asked for action of the fiscal court authorizing that the County Judge Executive or his designee be authorized to execute a contract with Southern Health Partners for a full spectrum of health care services in the Kenton County Detention Center, inasmuch as the nursing staff has chosen to seek other career opportunities and left the center in a precarious situation.
Deputy Kimmich explained there would be a six-month contract and an evaluation would be done to determine if bidding is necessary in July. He explained that for a fee of $4.50 per month per inmate, SHP indemnifies the county against litigation arising from the health care system in the jail. He explained that the county jailer is supportive of the contractual arrangement, and that upon approval of the concept by the court, he will forward the contract to the county attorney for his review and concurrence as to form and classification before execution of same.
Commissioner Kris Knochelmann moved approval of the execution of the contract upon review by the county attorney. Commissioner Sara Reeder-Voelker seconded the motion and there being no further discussion, Judge Drees called for a roll call vote whereupon all members present voted in the affirmative.

BUDGET CALENDAR SCHEDULE: Mr. Knochelmann presented a budget preparation calendar for the FY 2008-2009 budget and asked for the court to ratify the schedule (enclosed).
Commissioner Dan Humpert moved approval of the budget preparation schedule as recommended. Commissioner Sara Reeder-Voelker seconded the motion and there being no further discussion, Judge Drees called for a roll call vote whereupon all members present voted in the affirmative.
Human Resources Director Joe Shriver advised he had no report.
County Attorney's Report Garry L. Edmondson advised he had no report.
Commissioners' Reports Commissioner Dan Humpert had no report.
Commissioner Sara Reeder-Voelker had no report.

Executive Session There was no need for an executive session.
Adjournment
There being no further business to come before the fiscal court, Judge Drees advised he would entertain motion to adjourn. Commissioner Dan Humpert moved adjournment and Commissioner Kris Knochelmann seconded the motion. Judge Drees called for a voice vote whereupon all members present voted in the affirmative.
